Welcome to Maarge (the "Application"), a software platform designed to support users in organizing caregiving activities for family members or clients. By accessing or using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms" or "Agreement"). If you do not agree with these Terms, you may not use the Application.

1. Age Restrictions & User Eligibility

1.1 Minimum Age Requirement

You must be at least 13 years of age to use the Application. If you are under 18 (or the age of majority in your jurisdiction), you may use the Application only under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

1.2 Legal Capacity

By using the Application, you represent that you have the legal capacity to enter into this Agreement. If you are using the Application on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Medical Disclaimer

2.1 No Medical Advice

Maarge is not a healthcare provider and does not provide medical advice, diagnosis, or treatment. Any health-related content or information accessible through the Application is provided for informational purposes only. Users should seek professional advice before making any medical or healthcare decisions.

2.2 No Guarantee of Compliance

Use of the Application does not guarantee compliance with any legal or regulatory standards (including HIPAA or other healthcare regulations). Each user is solely responsible for ensuring compliance with all applicable laws.

3. Account Creation & Responsibility

3.1 Registration

To access certain features, you must create an account. You agree to (a) provide accurate and complete information; (b) maintain the accuracy of such information; and (c) keep your login credentials confidential. You are responsible for all activities under your account.

3.2 Unauthorized Access

You must notify us immediately at support@maarge.com of any unauthorized use of your account or breach of security. Maarge is not liable for losses resulting from unauthorized use of your username or password.

4. Privacy & Data Use

By using the Application, you consent to the collection, use, and storage of your data in accordance with our Privacy Policy. We implement reasonable security measures but cannot guarantee complete security.

You may request deletion of your data at any time by contacting support@maarge.com, using our account deletion page, or the data deletion request form.

5. Acceptable Use & User Content

The Application is intended to organize caregiving activities. You agree not to use the Application for any illegal or unauthorized purposes, upload false or harmful content, or disrupt the Application's functionality or security.

You retain ownership of any content you upload. By providing user content, you grant Maarge a non-exclusive, royalty-free license to use, store, display, and process such content solely for the purpose of operating the Application.

6. Support & Service Commitments

We provide support (primarily via email) during the term of this Agreement and will use commercially reasonable efforts to address reported errors or issues. We do not guarantee uninterrupted or error-free service.

7. No Medical Liability, Warranties & Disclaimers

Maarge and its affiliates are not liable for any medical outcomes, healthcare decisions, or events arising from reliance on the Application. THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

8. Limitation of Liability

To the fullest extent permitted by law, Maarge shall not be liable for any indirect, incidental, special, consequential, or punitive damages. If liability cannot be excluded, it shall be limited to the fees you paid to Maarge in the twelve (12) months preceding the incident.

9. Indemnification

You agree to indemnify, defend, and hold harmless Maarge and its affiliates from any claims arising out of your access to or use of the Application, your violation of these Terms, or content you submit through the Application.

10. Termination

We reserve the right to suspend or terminate your access to the Application at our sole discretion, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Application or other users.

11. Dispute Resolution & Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any dispute shall be settled by binding arbitration in California, in accordance with the rules of the American Arbitration Association.

12. Intellectual Property

All rights, title, and interest in and to the Application (excluding user content) are and will remain the exclusive property of Maarge LLC. You shall not copy, modify, distribute, sell, sublicense, reverse-engineer, or attempt to extract the source code of the Application.

13. Third-Party Data and Licensing

Our application incorporates drug information sourced from the RxNorm database, maintained by the U.S. National Library of Medicine (NLM). Use of this data is subject to the UMLS Metathesaurus License Agreement.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting a notice on our website or emailing you. Your continued use of the Application after changes become effective indicates your acceptance of the new Terms.
